THE FIGHT LAB

SAFETY WAIVER AND RELEASE OF LIABILITY

The client is entering into an agreement with THE FIGHT LAB by Lee Bros that may include exercise, martial arts instruction, striking, grappling, sparring, drilling, pad work, bag work, strength and conditioning, and other physical activity. To participate in this program, the client acknowledges that he or she is in sufficiently good health and physical condition to participate and does not have any condition, ailment, injury, illness, allergy, or other limitation that would prevent safe participation or create an unreasonable risk to himself/herself or others. If any such condition is present, the client represents that it has been fully disclosed prior to participation and that he or she has obtained any appropriate medical clearance recommended by a physician or other qualified medical provider.

This waiver applies to participation in any and all activities at or through THE FIGHT LAB, including but not limited to jiu-jitsu, Muay Thai, kickboxing, boxing, fitness training, private lessons, group classes, open mat, sparring, competitions, seminars, camps, events, demonstrations, and use of the facility, equipment, restrooms, and premises.

In consideration of being allowed to participate in any way at THE FIGHT LAB, its related events and activities, I, the registrant, the undersigned, acknowledge, appreciate, and agree that:

The risk of injury from the activities involved in this program is significant, including the potential for bruises, cuts, sprains, strains, fractures, concussions, joint injury, head and neck injury, exposure to bacteria, viruses, or other communicable illnesses, permanent disability, paralysis, and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, foreseen and unforeseen, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and

I willingly agree to comply with the stated and customary terms and conditions for participation, including all safety rules, hygiene expectations, coach instructions, and facility policies. If, however, I observe any unusual or significant hazard during my presence or participation, or if I experience any pain, dizziness, illness, injury, or other concern, I will remove myself from participation and bring such to the attention of the staff immediately; and

I understand that THE FIGHT LAB is relying on my representation that I am physically able to participate. I acknowledge that THE FIGHT LAB has not made any representation regarding my fitness to participate and is not providing medical advice, diagnosis, or treatment.

I agree that I will not participate, and I will not allow my minor child to participate, while sick with a fever, vomiting, diarrhea, a known contagious illness, or any condition that could reasonably put others at risk. I agree that if I have any injury, medical condition, or physical limitation, or if I become pregnant, ill, or injured, it is my responsibility to consult with an appropriate medical professional before participating or continuing to participate. If I am pregnant, think I may be pregnant, or become pregnant during the course of participation, I understand that it is my responsibility to consult my physician before participating and to notify THE FIGHT LAB of any restrictions relevant to my training. I authorize THE FIGHT LAB, its staff, coaches, agents, and representatives to obtain emergency medical care for me and/or my minor child if deemed reasonably necessary, including first aid, emergency transport, and medical treatment. I understand that I am solely responsible for all costs associated with such care.

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE FIGHT LAB / Lee Brothers Submission Academy LTD, and each of their owners, officers, officials, agents, employees, coaches, independent contractors, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I understand and agree that participation may also include competitions, off-site events, seminars, camps, or other activities conducted away from the main facility, and this waiver shall apply to those activities as well. I understand that THE FIGHT LAB is not responsible for lost, stolen, or damaged personal property, including uniforms, gear, jewelry, phones, wallets, or other belongings brought onto the premises or to any related event. I understand and agree that this release is intended to be as broad and inclusive as permitted by applicable law and that if any portion is held invalid, the remaining portions shall continue in full legal force and effect.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARENTS / GUARDIANS OF PARTICIPANTS UNDER 18 YEARS OF AGE: This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her participation and to his/her release as provided above of all the Releasees, and, for myself, my child, and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law. I represent that I am the parent or legal guardian of the minor participant and that I have the legal authority to sign this agreement on the minor’s behalf. I further agree to instruct my child to follow all gym rules, coach instructions, and safety procedures.

I understand that martial arts and striking/grappling activities may involve controlled physical contact with coaches, staff, and other participants, and I consent to such contact for myself and/or my minor child as part of participation in training and instruction.

Photo / Video / Media Release

I authorize THE FIGHT LAB to use photos, videos, and other recordings or likenesses of myself and/or my child or the child for whom I have legal guardianship, for promotional, educational, advertising, and marketing materials. Such likenesses will not be sold to other parties.

Promotional materials bearing these likenesses may be distributed via social media for marketing purposes and/or posted on THE FIGHT LAB website, email communications, digital advertisements, printed materials, and other marketing channels owned or controlled by THE FIGHT LAB.

THE FIGHT LAB reserves the right to use any photo or likeness for a time period beginning when this form is signed and ending upon written request of participant, parent, or legal guardian. I understand that any revocation will apply prospectively only and will not require THE FIGHT LAB to remove or recall materials already produced, published, posted, or distributed prior to receipt of the written request.
